      Location History Offered as Evidence

      Location data looks like the most objective evidence imaginable and requires more careful reading than almost anything else. The margin of error varies by two orders of magnitude between sources, and every record places a device rather than the person it belongs to.

      The rule in short

      Location evidence comes from satellite positioning, from network cell sites, from wireless network observations and from application check-ins, each with a different accuracy. All of it places a device rather than a person. Interpreting it responsibly means establishing which method produced each point and what margin that method carries.

      Location data has an authority that other evidence struggles to match, and it is routinely presented without the one thing that makes it meaningful: an account of how each position was derived and how wrong it might be.

      Where location data comes from

      Satellite positioning. Accurate to a few metres outdoors with a clear view of the sky, and considerably worse or entirely unavailable indoors, underground or among tall buildings.

      Cell site records. Held by carriers, indicating which sector of which mast a device used, which describes an area rather than a point and can span kilometres in rural coverage.

      Wireless network observations. Devices note nearby networks, and databases mapping those networks to positions produce estimates that are accurate in dense areas and poor elsewhere.

      Application check-ins and tags. Positions recorded when somebody used an application, which are accurate to whatever the device reported at that moment and exist only where the application was used.

      Derived and inferred positions. Some services record a position estimated from several sources or interpolated between known points, and those entries are calculations rather than observations.

      Each carries its own margin. A dataset mixing all of these presents them identically, and reading them as equivalent is the commonest error made with this material.

      What it does not establish

      Who was holding the device. A phone in a bag in a car establishes where the bag was, and nothing whatever about who was carrying it or who was driving.

      What the person was doing. A position is a coordinate, and the activity associated with it is an inference drawn by whoever is reading the record.

      Precision beyond the method. A cell site record presented as a point on a map has been converted from an area into a dot by somebody's choice of presentation.

      Continuous presence. Location records are samples rather than a continuous track, and the intervals between them are frequently long enough to accommodate a great deal.

      That a gap means anything. Devices lose signal, batteries die and settings change, so absent data is ordinarily explained by circumstance rather than by concealment.

      Reading a dataset responsibly

      Establish the source of each point. Most exports record which method produced a position and an accuracy figure, and those two fields are more important than the coordinates.

      Read the accuracy radius. A position with a stated accuracy of two kilometres is a statement about an area the size of a town, and plotting it as a pin misrepresents it.

      Check the time zone. Location records carry timestamps subject to the same problems as any other, discussed in what metadata records.

      Look at the sampling rate. A device recording once an hour tells a very different story from one recording every thirty seconds, and the difference is a settings question.

      Beware the plotted map. A map produced from a dataset embeds interpretation, and the underlying table is what should be examined rather than the picture made from it.

      Read the accuracy column

      Every location export contains an accuracy field, and it is the field nobody looks at. A point with a stated accuracy of three kilometres and a point accurate to five metres appear identically on a map and mean completely different things.

      Cell site evidence in particular

      It shows which sector served the device. Which is an area determined by antenna direction, terrain and network load rather than a simple radius around a mast.

      Coverage is not geometric. A device does not always use the nearest mast, because load balancing, obstruction and signal conditions all affect which sector serves it.

      Areas vary enormously. Urban sectors may cover a few hundred metres and rural ones many kilometres, so the same type of record means very different things in different places.

      Survey work is sometimes required. Establishing actual coverage in a particular place involves measurement rather than assumption, which is expert work, per who qualifies as an expert.

      It is nonetheless powerful. Establishing that a device was in the general area of an event, over a period, is frequently all that a case actually needs.

      Obtaining and preserving it

      The account holder can export it. Platforms that record location history include it in the self-service download, which is the fastest and most complete route by a wide margin.

      Carrier data requires process. And carries the notice requirements and short retention periods described in what a phone actually holds.

      Preserve immediately. Location data is among the shortest-lived categories held by carriers, and the window is frequently measured in weeks.

      Get the raw export, not a summary. A table with accuracy figures and source fields can be assessed; a map or a narrative summary cannot.

      Settings history matters. Whether location recording was enabled, and when it changed, explains gaps and is usually recorded in the account itself.

      Location evidence is genuinely powerful and routinely over-read. The coordinates in a dataset are the least informative part of it. The source field and the accuracy figure attached to each point are what determine whether the record establishes anything at all, and they are the two columns nobody looks at before plotting the data on a map.

      The device-and-person distinction is worth repeating in any submission relying on this material. A record places a handset at a coordinate, and the inference that a particular individual was with it is a separate step. It is usually an easy step, because people carry their phones, and it fails precisely in the situations where it matters most.

      Cell site evidence deserves particular caution because the geometry is counterintuitive. Sectors are shaped by antenna direction, terrain and network load rather than by distance, devices do not reliably use the nearest mast, and a coverage claim unsupported by survey work is an assumption dressed as a measurement.

      Gaps in a record are the feature most frequently over-interpreted. Signal loss indoors, flat batteries, aircraft mode and changed permissions account for the overwhelming majority of them, and every one produces a gap identical in appearance to a deliberate one. Treating an absence as evidence requires excluding those causes rather than ignoring them.

      Practically, three things follow. The account holder's own export beats every other route for completeness and speed, the carrier retention window closes faster than any other source in the file, and the raw table with its accuracy figures matters a great deal more than any map somebody has produced from it.

      Questions readers ask

      Does location data prove where a person was?

      It proves where a device was, to within whatever margin the recording method carries, at the moments it recorded. Connecting the device to a person is a separate inference, and in most cases an easy one — people carry their phones — but it is an inference that has to be made rather than assumed, and it fails in exactly the situations where it matters most: a phone left at home, lent to somebody, or sitting in a vehicle driven by another person.

      Why do cell site records cover such large areas?

      Because a cell site record shows which antenna sector served the device rather than a position. The area covered by a sector depends on the antenna's direction and power, the terrain, the density of surrounding masts and how busy the network was at the time. In dense urban areas that can be a few hundred metres; in rural coverage it can be many kilometres. Establishing actual coverage in a particular place requires measurement, not assumption, which is why cell site analysis is treated as expert evidence.

      What does a gap in location history mean?

      Almost always something mundane. Devices lose signal indoors and underground, batteries run flat, aircraft mode is enabled, applications are closed, and location permissions are changed. Any of those produces a gap identical in appearance to one produced deliberately. Because the innocent explanations are so numerous, an argument built on a gap needs to exclude them, usually by showing that the device was demonstrably in use for other purposes during the same period.
